This document outlines the Terms of Use for the RuralXPress platform, including its website, mobile site, and mobile application, which are all referred to as the "Platform." It is an electronic record in accordance with the Information Technology Act, 2000, and does not require physical or digital signatures.

The Platform is owned by **Agrisakthi Marketplace Private Limited**, a company with its registered office at Buildings 107, G.H.Backside, Mathur. Krishnagiri District, India.

By using the Platform, you agree to these Terms of Use and the applicable policies, which form a binding contract with Agrisakthi Marketplace Private Limited. If you disagree with any part of these terms, please do not use the Platform.

Key Terms and User Obligations

Definitions

• You or User: Any person who uses the Platform, whether as a registered user or a guest.
• We, Us, Our: Agrisakthi Marketplace Private Limited.

Membership Eligibility

To transact on the Platform, you must be a person who can form a legally binding contract under the Indian Contract Act, 1872. If you are a minor (under 18), you may only use the Platform under the supervision and with the prior consent of a parent or legal guardian.

Account and Registration

You are responsible for maintaining the confidentiality of your Display Name and Password. You agree to provide accurate and complete information, and we reserve the right to suspend or terminate your account if we have reason to believe the information is false or incomplete. Your mobile phone number and/or e-mail address are your primary identifiers on the Platform.

Prohibited Content and Activities

You agree not to host, display, upload, or share any information that is harmful, harassing, defamatory, obscene, pornographic, or illegal. Prohibited activities include, but are not limited to, transmitting "junk mail," promoting illegal activities, violating third-party rights, or impersonating another person. You may not use any automated device or program to access or monitor the Platform without our consent.

Platform for Transactions (Intermediary Role)

RuralXPress is an intermediary platform that facilitates transactions between buyers and sellers. **We are not a party to the contract between the buyer and the seller.**

Commercial Terms

All commercial and contractual terms, such as price, shipping, payment methods, and warranties, are offered by and agreed upon solely between the buyers and sellers. We do not control, determine, or advise on these terms.

Order Placement

Placing an order is an offer by the buyer to purchase a product from the seller. The seller has the right to cancel any order at their sole discretion.

Disclaimers

We do not provide any warranty regarding the specifics of products or services, nor do we implicitly or explicitly endorse any products. We are not responsible for any non-performance or breach of contract between buyers and sellers.

Business Purchases

For eligible products, you may be able to avail GST input tax credit. An invoice with your provided GSTIN will be issued by the seller. We are not responsible for verifying the accuracy of the details you provide or for your ability to claim the tax credit.

Fees and Charges

Platform Fee

We may charge a nominal platform fee to maintain efficient operations. This fee is generally refundable in cases of order loss, undelivery, or full/partial cancellation.

Convenience Fee (RuralXPress Flights)

For travel booking services, we may charge a convenience fee in addition to the cost of the booking. This fee is subject to change.

Goods Transport (GT) Charges

For delivery of products, you agree to pay "GT Charges" to the Transporter, which we are authorized to collect. These charges are for logistics and delivery services, and **ownership of the product transfers to you when the seller hands it over to the Transporter.**

Product-Specific Services and Policies

For Prescription and Non-Prescription Drugs

The Platform is for informational and communication purposes. We do not sell or distribute medicines. All orders for prescribed medicines are forwarded to licensed sellers who verify prescriptions before dispensing. You are advised to consult a professional health care provider for any medical advice.

Teleconsultation Services

We may connect you with third-party professionals for teleconsultation in specific cases where prescription validation is required. These professionals are independent contractors, and we are not liable for their advice, medical negligence, or any loss or damage you may incur.

Tobacco Products

You must be at least 18 years old (21 in Karnataka) to purchase tobacco products. You also confirm that the delivery location is not within 100 meters of an educational institution.

Replacement and Return Guarantee

We have a Replacement Guarantee to assist buyers who have been defrauded. The return policy period depends on the product and seller. Items with defects or damages at the time of delivery are eligible for replacement. Certain items, such as used or tampered products, are not eligible.

Ratings and Reviews

We have a strict policy regarding product reviews. Reviews must be genuine, comply with our content policies (prohibiting profanity, personal information, etc.), and are subject to moderation. Only users with verified purchases can leave reviews.

Dispute Resolution

If a dispute arises, you can contact our customer support team to mediate. The Buyer Protection Program is available for eligible buyers who cannot resolve a dispute with the seller.

Legal and General Provisions

Disclaimer of Warranties

The Platform and all its contents are provided "as is" and "as available" without any warranties. We do not guarantee that the Platform will be constantly available or that the information is accurate and error-free.

Limitation of Liability

We are not liable for any special, incidental, indirect, or consequential damages arising from your use of the Platform.

Indemnity

You agree to indemnify and hold us harmless from any claims, demands, or damages made by a third party due to your breach of these Terms of Use.

Governing Law

These Terms of Use are governed by the laws of India. The exclusive place of jurisdiction is Bengaluru.

Intellectual Property

All material on the Platform, including images, text, and trademarks, is protected by copyright and other intellectual property rights. You may not copy, reproduce, or distribute this material without our prior written consent.
